Donald Pollock: The Consumer Owns the Data - The Utility Manages It

The consumer owns the data as soon as it exits the data warehouse and is transiting the network to the consumer. If data is stored in the Meter, then this is consumer owned data, as it is outside the confines of the utility data warehouse.

When data is in the data warehouse it is the consumer’s, just as a health record is a consumer’s when stored by a hospital, with a right to expect a secured privacy and protection just as with HIPPA. The utility has the right to access the data for billing, analysis, and aggregation for use in overall statistics that are published. The utility is not allowed to sell the specific customer data, with the customer’s identity and location provided, it may only sell summary data without identifying information.

Yes, consumers and their agents should have a right to access the data stored in the Meter or a reasonable like amount of data if they are transiting the Internet to a secure site to gather this data. The access of the data should be able to be by consumer or agent manual actions or automated means, so long as proper and thorough identification, authentication, and authorization procedures are followed.
